The website of The Indonesian Directorate General of Immigration this week have posted an update to the provisions for ITAS for foreign investors who concurrently serve as Directors or Commissioners.
After the critical period of the Covid-19 pandemic has passed, Immigration as a national development facilitator, seeks to facilitate investment, especially for investors from abroad.
In this regard, foreign investors (PMA) guarantors need to understand that Investor’s Limited Stay Permit (ITAS) requires a minimum investment fund of IDR 1-billion.
“Foreigners who are directors or commissioners and invest with a value that meets the requirements are not required to include RPTKA/IMTA and can use Investor ITAS,” explained Director of Immigration Stay Permit, Pramella Yunidar Pasaribu confirmed on Tuesday (20/09/2022).
The minimum investment value requirements for Visa applications and Limited Stay Permits in the context of Foreign Investment (Investors) are as follows:
- Pure PMA Vitas: IDR 1,125,000,000
- PMA Vitas Concurrently Director/Commissioner: IDR 1,000,000,000
- ITAS PMA Concurrently Director/Commissioner: IDR 1,000,000,000
- Pure PMA ITAS: IDR 1,125,000,000
“We also emphasize that foreign nationals holding ITAS or ITAP Investors who hold concurrent positions may carry out activities because their position as directors/commissioners has the authority, responsibility and rights as part of the company’s organs. Of course, those concerned have an interest in the company running well. That way, it is possible to have supervisory, coaching and managerial functions to ensure the company runs well,” he continued.
Meanwhile, foreigners who serve as directors/commissioners of the company and invest less than IDR 1-billion must use an ITAS or work ITAP. Thus, when managing foreign workers, they are required to include document requirements from the Ministry of Manpower.
The submission of concurrent positions to the immigration office is carried out no later than 30 (thirty) days from the fulfilment of the required documents. If the application for multiple positions is submitted because the position is obtained at almost the same period, then it can be served with only one application.
“We also urge the person in charge or guarantor to pay the non-tax state revenue (PNBP) on the same day after receiving the Proof of Introduction to Payment which is also a Receipt of the Application,” he said.
